On Monday, Judge Juan Merchan of New York determined that the hush money case involving President-elect Donald Trump should continue and not be dismissed based on the Supreme Court’s decision concerning presidential immunity.

Following a conviction in May for 34 counts of falsifying business records, Trump’s legal team has explored various strategies to have the case dismissed, including a formal motion to eliminate the case now that he has assumed the presidency, a matter on which Merchan has not yet issued a ruling. In his comprehensive 41-page ruling, Merchan focused on Trump’s claim of presidential immunity, stating that the trial’s evidence pertained “entirely to unofficial conduct” and therefore does not warrant “any protection of immunity.”

Spokesman for Trump’s campaign, Steve Cheung, remarked in a statement that Merchan’s ruling represents a “direct violation of the Supreme Court’s ruling on immunity, along with other established legal principles.”

According to CNN, Trump’s legal representatives are likely to appeal this ruling. Trump has not yet received his sentence, as prosecutors had previously concurred that he would not be sentenced while serving as president.
